This Terms of Service ("Agreement") is a legal contract between you ("User," "you," or "your") and AnimateMaps ("Company," "we," "our," or "us") regarding your access to and use of our website, software, tools, APIs, and related services (collectively, the "Service").
By accessing or using the Service in any manner, you confirm that you have read, understood, and agreed to be bound by this Agreement. If you do not agree, you must not use the Service.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service in accordance with this Agreement and your subscription plan.
All rights, title, and interest in the Service, including all software, design, and data (excluding your User Content), belong to AnimateMaps.
You must provide accurate, current, and complete information during registration and keep it updated.
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
Notify us immediately if you suspect unauthorized access. We are not liable for losses caused by your failure to safeguard your credentials.
Simultaneous login from multiple devices/browsers under one account may be restricted or result in suspension.
To use our Service, you must be at least 13 years old, or the age of digital majority in your jurisdiction, and have the consent of a parent or guardian if you are under 18.
You are responsible for maintaining the security of your account and any content you generate using our service.
Pro and Enterprise subscriptions are billed monthly. Refunds are handled on a case-by-case basis.
Users must not use AnimateMaps for any illegal purposes or to create content that violates copyright or other intellectual property rights.
We may suspend or terminate your access to the Service at any time, for any reason, including violation of this Agreement.
The Service is provided on an 'as-is' and 'as-available' basis. We make no warranties, express or implied, regarding the Service.
To the fullest extent permitted by law, AnimateMaps shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses, resulting from:
Your access to or use of, or inability to access or use, the Service;
Any conduct or content of any third party on the Service;
Any content obtained from the Service;
Unauthorized access, use, or alteration of your transmissions or content.
You agree to defend, indemnify, and hold harmless AnimateMaps, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, service providers, subcontractors, suppliers, and successors (collectively, the 'Service Providers') from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service, including, without limitation, any User Content you provide, any use of the Service's content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from the Service.
This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which the Company is located, without regard to its conflict of law principles.
We may modify these Terms at any time. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
